In a country where justice is delayed, but sometimes never even arrives, the Supreme Court of Justice of Argentina is taking a bold step into the future. Artificial intelligence (AI) promises to transform the judicial system, but not without raising a storm of ethical questions and colossal challenges.

 

The Technological Dream

 

Let's imagine a world where case files don't pile up for months in court offices. Where a sentence can be issued in a matter of days, not years. This is the future being sold to us with AI. Systems like Prometea, which already operate in the Prosecutor's Office of the City of Buenos Aires, promise to process documents at unimaginable speed and with mathematical precision. But what happens when you introduce a machine into the sanctuary of justice?

 

Technical and Human Challenges

 

The implementation of AI in justice is not merely a matter of technology but trust. Algorithms are not infallible. They are designed by humans and, as such, carry all the biases and flaws inherent to our species. A system that automates judicial decisions must be subjected to rigorous human supervision. But who supervises the supervisors?

 

Moreover, there is the issue of training. Are our judges and judicial employees ready to handle these advanced tools? The reality is that most judicial staff are more familiar with traditional paperwork than with binary code. Adapting to this new reality will require a significant investment in education and continuous training.

 

The Ghost of Impartiality

 

One of AI's greatest attractions is its supposed impartiality. Unlike humans, machines have no biases... or do they? Algorithms draw on historical data to make decisions, and if that data is biased, the results will be too. Imagine a system trained with data from historical sentences that reflect decades of discrimination and inequality. Instead of correcting these issues, AI could perpetuate and even exacerbate them.

 

Privacy and Security

 

Then there's the matter of privacy. AI systems require access to a vast amount of data to function correctly. This raises a delicate issue: how do we protect sensitive citizen information? A security breach could have catastrophic consequences, with personal and judicial data exposed to the highest bidder on the dark web.

 

Transparency and Accountability

 

Transparency is another critical issue. Judicial decisions must be clear and understandable. But algorithms, by their nature, are opaque. Understanding how an AI reached a particular conclusion can be as difficult as unraveling the mysteries of the universe. We need to ensure that automated decisions are auditable and explainable.

 

The Future of Justice

 

The Supreme Court of Justice of Argentina stands at a crossroads. AI has the potential to revolutionize the judicial system, making it faster and more efficient. But we must not lose sight of the enormous ethical and technical challenges this revolution entails.

 

The future of our justice cannot be in the hands of soulless, conscious-less machines. Technology should be a tool, not a judge. We must address these challenges with the seriousness and rigor that justice deserves. Because, at the end of the day, behind every case file, every sentence, and every decision, there are human lives at stake.
